In addition to our standard Terms & Conditions below, an update for COVID-19 applies to our refund policy.
Should your group not be able to travel to Maldives due to COVID related travel restrictions in place - i.e. your country prevents travel to Maldives, or Maldives prevents entry to travellers from your country, then you will be entitled to a trip reschedule to be taken within 18 months from your original charter date.
In the unlikely event that we have to cancel your trip due a COVID-related issue eg yacht placed in quarantine due to positive case or direct contact with positive case, we will endeavor to rebook you on another yacht of similar standard for the same or similar dates as your trip. If this is not possible, we will offer a trip reschedule to be taken within 18 months of your original charter date.
Please ensure you have travel insurance that includes COVID-cover for travel disruptions.

Sail Shantaram is operated by Indian Ocean Charters LLC. Herewith the T&C's:
1. The charterer and all members of their party acknowledges that they understand the inherent risks of a sailing charter, including but not limited to, the hazards of sailing, diving, snorkeling, surfing, equipment failure, perils of the sea, acts of other participants & adverse sea & weather conditions and are willing to assume such risks. Guests understand they have a duty to exercise personal care for their own safety and agree to do so.
2. Indian Ocean Charters LLC gives notice that all arrangements made by us are on the condition that we shall not be liable or responsible for any loss or additional expenses incurred as a result of accident, injury, sickness or death, or additional expense due to delays in changes in air, road, rail, sea or other services, strikes, war, weather or other causes.
3. Without prejudice or liability on the part of Indian Ocean Charters LLC, guests are required to take out personal insurance to cover, inter alia, personal accident/injury, travel costs arising from changes in the yacht’s passage plan, loss or damage of personal property, loss of booking fees in the event of cancellation.
4. The charter is not booked until the completed Booking Form and a deposit of 30% of the fee has been received. Provisional bookings by phone or e-mail will be held for 10 days pending receipt of the Booking Form and deposit. Every person making a booking on behalf of an individual or group of individuals warrants and confirms that he/she has the authority of that individual and that each such individual agrees to be bound by these Terms & Conditions. Indian Ocean Charters LLC reserves the right to alter prices in accordance with any major changes in cost which may occur between the time of the booking and the time of departure.
5. Guests signing the Booking Form are declaring that they, and all persons on whose behalf they are booking, are in good health and are fit, mobile and agile. Any illness arising between booking the holiday and actual departure must be declared. The skipper may refuse to carry any individual on any charter for any cause relating to the safety of the vessel or any property or other persons on board. In such circumstances the individual shall not be entitled to any compensation or payment whatsoever.
6. In the unlikely event, due to circumstances beyond our control, we cannot provide the charter booked or a suitable alternative, or an alternate date, we will refund all money paid, in full, and the Charterer shall have no further claim against us.
7. The Charterer, whether an individual, or booking the whole vessel, is responsible for the whole of the fee he/she has undertaken to pay and must pay the balance at least 30 days before the start of the charter period. We may cancel the charter if the balance of the charter cost is not paid on time and will retain the deposit. If for any reason, the guest cancels the booking, he/she remains responsible for the whole of the fee. Holiday cancellation insurance is highly recommended.
8. The vessel carries full Marine Insurance policies for Loss & damage to vessel, & Public Liability. The yacht’s insurance does not cover you for any injury, damage or loss to you or your property. Furthermore, our insurance does not cover charterers who are away from the vessel or its tender whilst engaged in watersports or other activities, nor does it cover loss of or damage to passengers’ gear, property or valuables whilst onboard or in transit. We therefore recommend that you ensure that your own travel/personal/household insurance cover any injuries and losses.
9. The charterer and all members of their party fully understand that the Yacht has limited medical facilities and that in the event of illness or injury, appropriate care must be summoned by radio and treatment will be delayed until they can be transported to a proper medical facility. No representations are made, implied or otherwise, that the crew can or will perform safe rescues or render first aid. In the event the charterer or one of their party show signs of distress or call for aid, it is understood that they would like assistance and will not hold Indian Ocean Charters LLC, it’s crew or employees responsible for their actions in attempting the performance or rescue of first aid. Indian Ocean Charters LLC is not liable for medical or evacuation related costs.
10. No children under the age of 8 can be carried without prior arrangement. Children are the responsibility of their parents/guardians at all times. No animals shall be carried.
11. No drugs, other unlawful goods or pornographic materials are permitted on board the vessel and the passenger(s) shall free and release Indian Ocean Charters LLC and its employees from any liabilities or responsibility arising out of any breach of this condition. Smoking is not permitted below deck, but may be permitted on deck providing it does not disturb other guests.
12. Cancellation policy: more than 91 days before embarkation a 50% cancellation fee will be charged. No refunds for cancellations less than 90 days before embarkation. In the event of a global situation that prevents air travel or results in the Maldives not being open to tourists, Indian Ocean Charters LLC will offer to reschedule the charter to an acceptable date for both parties. Rescheduled trip to be taken within 1 year from original booking.
13. Indian Ocean Charters LLC’s skipper reserves the right to vary the charter in any way he considers necessary due to adverse weather or any other conditions. The skipper shall have ultimate responsibility for the safety of the vessel, its tender and those on board and his decision shall be final.
14. In the unlikely event that you have a complaint please report it to us as soon as possible so that we may deal with it promptly and to your satisfaction.
15. Seaplanes and local domestic airlines can give no guarantee of exact times or arrival or departure of any service and Indian Ocean Charters LLC will not be liable for failure to make connections to other services.
16. Any legal action or proceedings arising out of or connected with this contract shall be governed by South African Law and be submitted to the jurisdiction of the courts of South Africa. By signing this Declaration/Contract/Agreement the Charter and all members of their party explicitly acknowledge and agree in advance to these conditions, accept and willingly assume all risks and hazards related to, arising out of, or associated their participation in a sailing trip and voluntarily agree to release, discharge, and hold harmless Indian Ocean Charters LLC, its members, owners, crew and employees, from any and all claims of liability
17. Charterers agree that photographic, video and/or sound recordings in any medium made by Sail Shantaram of their participation in the Trip may be used for the general promotion of Sail Shantaram including in printed copy and via the internet.
